Summary of the Case:

The Respondent was detained for more than 30 days on suspicion of a crime, after which he was acquitted by a court and reinstated to his position. The Respondent sought the payment of salary arrears, salary increments, and bonuses for the period during which he was in detention.

Rule of Law:

To be entitled to bonuses and other benefits, an employee must be available for work or have rendered service. There is no legal basis compelling the payment of a bonus to an employee who was absent from their duty station due to circumstances that constitute a legal ground for absence (e.g., detention).

Reasoning:

The fact that the Respondent remained in detention for more than 30 days constitutes a valid ground for termination of a contract of employment without notice pursuant to Article 27(1)(k) of Proclamation No. 377/2003. Although the employer reinstated the employee on its own initiative, the employee cannot claim a bonus for results achieved during a period in which they did not perform work due to their own circumstances (detention).

Ruling:

The decision ordering the employer to pay a bonus to the Respondent is hereby reversed, as it contains a fundamental error of law.
